I've had settlements out of court due to my fatal peanut allergy.
When you're fatally allergic to something and you tell them about it and they still do it, its actually a case over life and death, it's happened to me multiple times, I'm not saying he deserves 10 million, but if he did almost lose his life (didnt read article yet) then he does deserve some compensation if he told them about it.

As soon as you see mcdonald's and lawsuit in the same sentence you automatically picture fat people looking to take advantage of the system and get pissed off.
But if this guy really does have a severe allergy, made it very clear to not put cheese on his food, and they did anyway, then they should be liable for whatever medical costs he incurred.
$10 million is a crock of **** though. Maybe if his tongue had shriveled up and fallen out, or if his legs had fallen off for some reason.

I also want to say that I don't support people suing over small things, but a lot of people don't realize how serious allergies are and a lot of people actually do die from people just not caring, though it depends on a case to case basis.
If he truly did almost die or go into anaphalatic shock from the cheese, mcdonalds will probably give him something due to the neglagence of the employees and them not wanting it to go to public.

I don't like pickles either, so when I get the burger I lift up the bun to have a look see. I'm not even allergic and I still look.

You'd think HE would realize the seriousness of it then, no? And maybe check the ****in burger to see if there was cheese on it...

Hate to say it but you will find people that will take their allergy to their advantage like it sounds like he did and eat the cheese willingly in order to get a lawsuit.
Having a peanut allergy I have to check a ton of basic foods since everything is produced on the same assembly line, though if i taste any trace of a peanut, i spit the shi1 out, I don't swallow the food... the guy is messed up in some way, but I still know where hes coming from.

I should sue McDonalds also. Last time I went through the drive-through I orderd a double quarter w/cheese, and after driving away realized they had given me a regular quarter w/cheese. I was pissed. Next time, though, instead of going back and speaking to the manager, I am calling a lawyer. Yeah, this is America, Jack!!

it's not mcdonalds fault that one guy at the restaurant messed up one thing. It's ridiculous.

Yea I heard about this, just another idiotic frivolous lawsuit if you ask me. Covering medical bills is one thing (it was like $700) but 10 million? Give me a break..

Thats a little harsh, yeah what he is asking for is ridiculous, but allergies are not to be taken lightly, if you had to live with one you'd know what I'm talking about.

One of the reasons why he most likely won't get anything other than medical expenses is that cheese on a burger is easy to spot. Peanut allergies are a bit more tricky since anything even made with the oil or if it's finely ground is harder to detect so it's easier to unwittingly ingest peanuts.
