Man jailed for violating smoking ban
Man jailed for allegedly violating smoking ban
ABILENE, Texas ? One West Texas city is really serious about its smoking ban.
Just ask Brian Wayne Hendrix, who was arrested and jailed on an outstanding warrant for smoking in public. Hendrix, 44, said he was "flabbergasted" by the arrest, which came after an officer pulled him over Tuesday morning on a traffic stop.
"I never thought I'd be going to jail for smoking a cigarette, but I'd do it again," said Hendrix, (good for you!!)who was released from the Taylor County Jail after posting $150 bond Tuesday afternoon.
The city's smoking ban that went into effect Jan. 3 prohibits smoking in most public places and businesses. Hendrix is the first person in Abilene to be arrested on a warrant for smoking in a public place, Assistant Police Chief Mark Moore said.
"If we go to a place where there are a lot of people smoking with no regard to the smoking ban ordinance, we will enforce it," Moore said. "As long as it's law, we ask that they comply."
Teresa Borcik, Municipal Court administrator, said Hendrix was cited for smoking in a public place on Feb. 24 and had 10 days to appear in court to contest the charge or to pay the $150 ticket. When he didn't show up, an arrest warrant was issued March 6, she said.
Hendrix said he has been smoking since he was a teenager.
"As long as it is legal to smoke, I am going to keep smoking. I'm not going to quit any time soon," he said. "I think they are just trying to make more money for the city by messing with the smokers."

Why a ban on smoking when prohibition was flushed down the s***ter when they tried that?

i agree with u. Extreme regulation of smoking is absurd. I enjoy an occasional smoke and if the only place u can do it soon is ur home, rediculous???
most smokers are good about smoking anyway. No one sneaks cigarettes indoors in public places and a lot are careful about smoking around others (esp children) there is no need for increased restrictions.
and any argument about passive smoking outside is crap. It would be negligable iunless ur sitting right nest to a person and they blow smoke at u. If they dont like it then move

Prohibition was the ban on the manufacturing and selling of all alcohol - from 1920-1933.
They thought that banning alcohol would lessen crime and increase morality - but it just increased crime and morality's just always been in the crapper.

Its pretty ignorant to tell someone to move because they agree on an issue you disagree on. Is it not? They smoke because they are addicted and try but can't stop. Sure there are your exceptions. Wtf if I can't walk by someone smoking then I am weak. Nice comeback I guess.

Some people are allergic to certain types of perfume. Try banning all scented things to which people are allergic.

Some smokers are addicted, but all enjoy it. If they didn't enjoy it, they wouldn't do it.
Doing what you like does not make you mentally weak. The fact of the matter is that you stand a chance of dying from a multitude of other things long before lung cancer even becomes an issue.
Drinking would make one "mentally weak", you could even argue that bodybuilding makes you "mentally weak" because you're driven to work out by others' impressions of you. Sure, some do it for strength and for fun, but some people smoke because they enjoy it, so if we're going to throw out some ignorant blanket statements we might as well not discriminate.

Somebody is addicted. Still not thinking before you type. You said people can't tell you what you can do in your car so you can rape someone but they can't tell you what you want to do. About half of the PhDs at my old lab at AECOM smoked, and I'm willing to bet a "pack of cigarettes" that they're a hell of a lot smarter than you are, so let's keep the childish assumptions to a minimum shall we?
